Name 3 statutes that give power to the police to stop and search? Terrorism Act 2000 The Misuse Of Drugs Act 1971 Section 60 of the criminal justice and public order act 1994.
Name the main piece of legislation that deals with stop and search? Police and Criminal Evidence Act 1984- PACE.
What is reasonable suspicion? Code of Practice A - sets out that reasonable suspicion cannot be based on appearance OR past records ALONE.
What are the 4 things a police officer MUST do when stopping and searching? 1) Give a written report. 2) Only certain clothing can be removed in public. 3) Give their name,station and reason for the search. 4) It must be backed by a statutory power.
What is the Misuse of Drugs Act 1971? It gives the police the power to search for prohibited drugs.
What is the Terrorism Act 2000? This gives the police the power to ask for headgear and shoes to be removed in addition to outer coat, jacket, and gloves permitted under PACE.
What is Section 60 of the Criminal Justice and Public Order Act 1994? Gives police power to stop and search anyone for 24 hours in a certain area, must be authorized by senior officer. E.g Football match.
