STALKING AND HARASSMENT

Protection from Harassment Act 1997
1. Amended by S.111 Protection of Freedoms Act 2012
2. S1(1)
  1. A person must not pursue a course of conduct which amounts to harassment of another, and which he knows or ought to know amounts to harassment of another
    1. Must involve conduct of at least 2 occasions
    2. Conduct not restricted to actions
    3. Conduct does not have to be of same type
      1. Or done by the same person
3. S2
  1. A person who pursues a course of conduct in breach of Sec 1(1) is guilty of an offence and amounts to stalking

  1. Stalking and fear of violence
    1. A person (A) whose course of conduct amounts to stalking, and either causes another (B) to fear, on at least two occasions, that violence will be used against B, or causes serious alarm or distress which has a substantial adverse effect on B's usual day-to-day activities, is guilty of an offence
6. S2A - power of arrest with warrant
