    1. The unlawful killing of a reasonable person in being under the King's peace with malice aforethought, express or implied
    2. Actus reus - unlawful killing of a reasonable creature in being under the King's peace.
      1. The defendant killed
        1. Killing can be an act or omission.
          1. R v Gibbons V Proctor
        2. Causation
          1. Defendant cannot be guilty unless his act or omission caused the death
          2. King's peace
            1. Killing an enemy in war is not murder.
            2. Unlawful
              1. Killing must be unlawful
                1. E.g. killing due to self defence does not count.
            3. Mens rea- malice aforethought, express or implied
              1. If they have either, the person is guily of murder.

                  1. Deliberate killing
                  2. Indirect intent (MR)
                    1. Also known as oblique intent
                      1. The defendant's aim was not to cause death.

                      1. Where the defendant doesn't mean to kill the victim, but accidentally kills the victim in trying to kill someone else.
                        1. The intention to kill or seriously injure victim 1 is transferred.
