- 1Skilled PersonA skilled person is an unimaginative person, or team of uninventive people, with the common general knowledge available to a person in the field at the date of filing. They will only think the obvious and will not question general assumptions.
A skilled person is needed to decide whether there has been disclosure, for they understand the state of the art in the area of the invention. They do not actually have to see or touch the invention for it to have become available to the public, but they must have been free in law or equity to have done so. - 2Purposive ApproachThe purposive approach looks at the purpose or reason for making the claim.
- 3Swiss ClaimSwiss claim is designed for second use for known invention. The patent has to claim the use of a substance for the manufacture of a medicine for a specified new therapeutic use, as the board decided that as well as protecting first use, art. 54(4) also applied to send and subsequent medical uses.
