1st Degree Murder Act is done: (1) Willfully (intent to kill) (2) Deliberately (process of assessing) (3) Premeditation (thought about it beforehand)
2nd Degree Murder Act is done: Wilfully with knowledge that you will cause death or serious bodily injury but LACKS deliberation & premeditation - Heat of passion (unreasonable/imperfect) - Depraved Heart = extreme indifference to the value of human life and with a base anti-social motive
Voluntary Manslaughter Act is done: (1) NO intent to kill (2) reasonably provoked by victim (3) suddenly in the heat of passion
I Act is done with: (1) no intent (2) death was reckless OR negligent (accident)
Misdemeanor Manslaughter Punishes as involuntary manslaughter any killing that occurs in the commission of an unlawful act (felonY). No causation proved. Unintended homicide.
Larceny (1) Trespassory Taking (2) Carrying Away (asportation) of personal property of another (3) intent to permanently deprive the owner of the property *Larceny is a crime against POSSESSION, not OWNERSHIP so a thief can steal from a thief
