- 1What form could this come in the exam?Does sometimes come as an essay question on its own, and if it is in a problem question it will be with trespass.
- 2What steps should I take to answer a problem question?First identify whether it is a public or a private nuisance (want it to be a public nuisance to be able to claim for person injury)
If Public, identify class affected, the claimant has special damages, which are substantial and direct.
If Private, identify whether there is an interest in land, see who can sue, and go through the 5 possible ways it could interfere with your enjoyment of the land.
To finish off which both, defences, and remedies avaliable. - 3What is NuisanceIt is a land-related tort, and protects land owners.
It is a balancing act between someone having the right to use their land, and the right for someone else to enjoy their land. - 4What are the three types of nuisance in law?Statutory (not looked at in this course)
