Equality and Diversity

- The Rights are what we are legally entitled to
through legislation such as The Equality Act
2021
- Choice
- The ability to make your own decisions on a specific topic or
subject. It is the freedom for you to be able to say yes or no
and dictate your opinion on whether you want something to
happen
- It is about giving an individual the ability
to make a decision on what they want,
e.g: how they live, how they are
supported and what they are offered
- Confidentiality
- Confidentiality means ensuring personal information about
individuals such as personal care records are stored securely,
ensuring personal information about individuals is shared only
on a need to know basis, ensuring personal information isn't
spoken about so others can hear and that personal information
is respected
- Confidentiality should NEVER be broken unless the
individual is a risk to themselves or others
- The Caldicott Principals are there to protect individuals personal information
- Justify the purpose(s) of using confidential
information
- Only use it when completely
necessary
- Use the minimum that is required
- Access should be on a need to know basis
- Everyone must understand their responsibility
- Understand and comply with the law
- The duty to share information can be as important as the duty to protect
patient confidentiality
- Consultation
- Providing an individual with all information and advice on a
particular topic so that they are able to make an informed
choice into their care path or treatment. This allows an
individual to maintain dignity and feel as though they are in
control of the care that they receive
- Ways practitioners can support an individual's right to consultation
- Ask for their
opinion
- Listen to their views
- Ask what type of care they
would like, if it is possible
- Give information about the options available to
them
- Explain what different treatment options will involve
- Share decision making based on the individual's opinions
- Provide information about different treatments and explain their benefits and disadvantages
- Importance of Consultation
- Ensures services and support meet individuals needs
- To show, by seeking the opinions of individuals and their
representatives that they are being listened to and valued
- To comply with legislation and to ensure that individuals
right to consultation is being upheld
- Equal and Fair Treatment
- All individuals are treated with the same respect. They
cannot all be treated the same way as they all have
different needs however they should be offered
opportunities to meet their individual needs
- Treating people fairly means treating them in the way that is most
appropriate to their needs. This may mean care workers treat
individuals differently to others because different people have
different needs
- Equal and Fair Treatment involves:
- Treating individuals for the
needs that they have
- Being aware of and
understanding individuals
specific needs
- Respecting individuals diverse
differences
- Equal and Fair Treatment does NOT involve:
- Treating all individuals the same
- Failing to take into account individuals
preferences
- Making assumptions and generalisations about individuals needs - this is called
discrimination
- Protection from Abuse and Harm
- Vulnerable children and adults are protected from abuse and harm by
safeguarding procedures which all care settings needs to follow
- The CQC gives the following definition of safeguarding: "Safeguarding
means protecting people's health, wellbeing and human rights and
enabling them to live free from harm, abuse and neglect. It's fundamental
to high-quality HSC"
- Ways the Right of Protection from Abuse and Harm can be upheld:
- All staff must have DBS Checks
- What is a DBS Check?
- Disclosure and Barring Service
- 4 levels: Basic, standard, enhanced and enhanced with barred list(s)
- Specific pieces of information need to be
declared (e.g details of previous convictions0
- Ensures vulnerable individuals are cared
for by a trained professional and that
there is nothing on a practitioner's record
that could put individuals at risk
- All settings must have a Designated (Child) Protection Officer
- There must be procedures for reporting abusive behaviour
and discrimination
- Safety procedures must be up to date: Fire, Evacuation, Lockdown etc
- Staff must be trained in first aid, safeguarding and manual handling
- Regular risk assessments of equipment and activities
- Fully implementing the Health and Safety at Work Act
- High standards of hygeine
- Proper security measures must be in place
- Right to Life
- 'An individual's right to life is protected by the
human rights law. Everyone's right to life should
be valued and protected'
- Everyone has the right to live a safe and full-filling life
in which they are valued and respected
