1. court officer will provisionally decide a track AND
2. Serve on all P a NOTICE OF PROPOSED ALLOCATION
  1. Requires all P to file a DIRECTIONS QUESTIONNAIRE to be returned by a specific date
    1. Fast and Multi N181
    2. Small claims N180
    3. If parties do not complete
      1. Designated money claims
        further notice giving 7 days
        P's statement of case struck out
      2. Other claims
        Court will make an appropriate order
        order for directions
        Order striking out claim
        Order striking out defence and entering judgment
        listing the case for CMC
    4. Claimant usually pays an allocation fee
      1. If do not pay
        warning sent
        if ignored - claim struck out
        can be re-instated if fee then paid
  2. UNLESS directions already given for example after a dismiss app for summary judgment
assess monetary value of claim
1. disregard any amount not in dispute
2. disregard any claim for interest or costs
3. disregard allegation of counterclaim
4. claims with monetary value usually allocated to Normal track for that claim
5. no financial value? - judge will allocate to most suitable
  1. regard to discretionary factors
    1. nature of remedy sought
    2. complexity
    3. number of parties
    4. value of CC
    5. amount of oral evidence likely
    6. importance of claim to non-parties
    7. view of the parties
    8. circumstances of the parties
