Inherent powers Powers needed by creating a national government for the United States.
Reserve powers Powers that the Constitution does not give to the national government that are kept by the states.
Concurrent powers (Con means with) Powers shared by the state and federal governments.
Commerce Clause States that Congress shall have the power "To regulate Commerce with foreign Nations, and among the several States, and with the Indian Tribes."
Necessary and Proper Clause Aka: Elastic Clause Clause in Article I, Section 8 of the Constitution that gives Congress the right to make all laws "necessary and proper" to carry out its expressed powers.
Full faith and credit clause (Article 4) Provides that the various states must recognize legislative acts, public records, and judicial decisions of the other states within the United States.
Supremacy Clause (Article 6) It means that the federal government, in exercising any of the powers enumerated in the Constitution, must prevail over any conflicting or inconsistent state exercise of power.
Free exercise clause (1st Amendment) Protects citizens right to practice their religion as they please.
Establishment Clause (1st Amendment) Prohibits Congress to establish an official religion in the United States.
Due Process Clause (5th and 14th Amendment) Following established legal procedures.
Selective Corporation A case by case process by which the liberties of the Bill of Rights is applied to the state governments. By the Due Process Clause of the 14th amendment.
Equal Protection Clause (14th Amendment) Prohibits states from denying any person within its jurisdiction the equal protection of the laws.
