What is the principle of collective responsibility ? Under the Principle of collective responsibility each Commissioner has equal say in decisions. Therefore they also have equal responsibility.
What are the three types of voting ? Unanimity, Qualified Majority and Simple Major
What is Proportional Representation ? Proportional representation is a method of voting where seats are allocated in accordance with the number of votes.
What are the five common types of cases the Court of Justice of the European Union deal with ? Preliminary Ruling, Failure to fulfill an obligation, Annulment, Failure to Act and Direct Actions
Name three sources of EU Law. Treaties, Directives and Regulations.
Who does a Directive apply to ? The Directive is binding on all member states it is addressed too.
Who does a Regulation apply too ? A Regulation applies to all member states. It is also directly applicable.
Costa v ENEL [1964] What affect did this case have on UK and EU Law ? The case set at that as a result of singing EU Treaties, a member state had agreed to a permanent limitation on its right to pass its own laws.
Secretary of State for Transport, ex parte Factortame Ltd and Others [1991] The European Court of Justice ruled that the UK's Merchant Shipping Act 1988 was a breach of EU law and awarded compensation to the Spanish Fishermen.
