1998 Human Rights Act
- Until the year 2000, using
the European Convention
of Human Rights meant
taking cases to Strasbourg
as it was not part of UK
law.
- However, from 2000,
the Human Rights Act
made the rights from
the ECHR enforcable
in Uk courts, making it
quicker to use.
- Senior judges have to consider making a
'declaration of incompatibility' if an
existing UK law conflicts with the
European Convention of Human Rights
- Some people have criticised the Human
Rights Act as it allows everyone to have
rights (even criminals, in certain
circumstances).
- The reason that they allow
everyone to have rights is
because of the danger they
would face if they didn't.
- Many rights can easily
be claimed and the
best way to get
information is through
your Citizens Advise
Bureau.
