Tort Law Blueprint (application/pdf)

Tort law is a comprehensive body of civil law that examines how legal responsibility is assigned when individuals or entities cause harm to others. It explores the various theories of liability, the conditions under which conduct becomes legally actionable, and the mechanisms through which injured parties may obtain compensation. The field focuses on the relationship between wrongful conduct, injury, causation, and accountability, while also defining the defenses and privileges that may excuse or justify otherwise harmful actions.

At its core, tort law provides a structured framework for analyzing civil disputes involving personal injury, property damage, emotional harm, and economic loss. It establishes standards of conduct through doctrines governing intent, negligence, and strict liability, while also addressing questions of duty, breach, causation, fault allocation, and damages. In doing so, it seeks to balance the interests of plaintiffs and defendants by determining when losses should remain with the injured party and when they should be shifted to those who created or controlled the relevant risk.

Beyond resolving individual disputes, tort law serves broader societal objectives. It promotes accountability, encourages safer behavior, deters unreasonable conduct, and facilitates the fair distribution of losses resulting from accidents and wrongful acts. Through its doctrines and remedial principles, tort law functions as a legal system for managing risk, protecting legally recognized interests, and advancing principles of corrective justice and social responsibility.
