Advantages
Empowering - gives control to the parties.
Cheaper - don't have costs of going to court
Less stressful - less formal and adversarial
Private and confidentail
Win/win solution - both parties normally compensation to reach a win/win solution
Disadvantages
Power imbalance - if there is mediation may not be recommended to get a lawyer
Clear legal rights - may be compromised in mediation
No clear and consistent history of decision - ie precedent
Legally binding - can't make anyone pay up
