  1. Advantages
    1. Empowering - gives control to the parties.
      1. Cheaper - don't have costs of going to court
        1. Less stressful - less formal and adversarial
          1. Private and confidentail
            1. Win/win solution - both parties normally compensation to reach a win/win solution
    2. Disadvantages
      1. Power imbalance - if there is mediation may not be recommended to get a lawyer
        1. Clear legal rights - may be compromised in mediation
          1. No clear and consistent history of decision - ie precedent
            1. Legally binding - can't make anyone pay up
      2. Mediators
        1. In QLD there is the Dispute Resolution Centre (Dept. of Justice and Attorney General)
          1. Although mediation can occur without professional mediators, there are professional mediation services
