Mag. Court - Serious shit

When a defendant appears in Mag. Court for an Indictable only charge, this is a prelim hearing
Section 8 of the Magistrates Court Act 1980
1. Types of prejudical matter
  1. Any reference to evidence
  2. Any previous convictions
  3. Other info that may be prejudical
2. Names, ages, home address and occupations of the defendants and witnesses
3. The name of the court and the magistrates
4. The charge in full or summerized
5. If court was adjourned
6. Arrangements to bail
  1. DON'T REPORT WHY IT WAS REFUSED
7. Whether legal aid was granted
8. Reporting restrictions in force
9. Legal representatives of the parties
You can also report:
1. Basic protestations of innocence
  1. By the defendant or solicitor
2. Either way case has chosen jury
3. Scene setting info
4. Background info
When do they cease to apply?
1. If the defendant requests it
2. BUT REMEMBER OTHER RESTRICTION MAY APPLY E.G CONTEMPT
3. If for a either-way case, they will be dealt with summarily
4. Insufficient evidence to commit a defendent/s to Crown Court for an either way case
5. Expires when proceedings have concluded - no jury trail remains for defendant
