 Two students Tom & Sally, bring their Bibles to school so that they can read from them during free time.  They pray together at lunch before they eat. Should school officials allow them to continue these practices or is this in violation of the Constitution? Is this situation Constitutional? Amendment # Clause # Cite relevant text in Amendment:

Situation 1

A high school football coach was fired after praying with players his players during football games. Is this situation Constitutional? What do you think? Which amendment /freedom applies to this situation? Specifically, which clause?

Situation 2

Brandenberg (binary/octet-stream)

Clarence Brandenburg was arrested in connection with a KKK meeting in which he made anti-Semitic and anti-black statements and advocated for the possibility of "revengeance." In Brandenburg v. Ohio  the Supreme Court established that speech advocating illegal conduct is protected under the First Amendment unless the speech is likely to incite "imminent lawless action".

In 1977, members of a Neo-Nazi group organized a rally outside of the courthouse in Skokie, Illinois, a historically Jewish town.  They were going to appear in Nazi uniforms with swastika armbands, carrying Nazi banners and signs with the words “Free Speech for White People.”   Do you think they should be allowed to hold their protest? Why or why not? Which Amendment/freedom applies to this situation?

Situation 3 The "Skokie Case"

Caption: : National Socialist Party of America v. Village of Skokie is considered a "'classic' free speech case" In 1969 in Brandenburg v. Ohio Supreme Court had ruled that hate speech is protected under the First Amendment as long as it does not provoke violence.

Do you think members of Westboro Baptist Church of Topeka, Kansas should have the right to picket at the funerals of US soldiers armed with signs advertising “Thank God For Dead Soldiers” and “God Hates Homosexuals”? Is this situation Constitutional? Amendment #   Constitution USA video clip

Situation 4

A man suspected of a violent crime is brought in to the police station.  The alleged victim picks him out of a lineup as the man who attacked her. Police inform him that he has the right to refuse to answer questions, but they do not offer to let him speak to a lawyer. After being questioned for two hours, the man admits to the crime.   Which right (if any) is being violated? and Which amendment (if any)  offers protection against such a violation?

Situation 5

A public school principal smells smoke in the hallway, and believes it is coming from the girls’ bathroom. She walks into the bathroom and sees Susan standing by the sink. She suspects Tracy has been smoking, and demands to search her purse for cigarettes or other evidence of smoking. Were Tracy's rights violated? Which amendment relates to her situation?

Situation 6

John, a 14 year old public school student, wears a shirt to school that says ““Jesus Is Not A Homophobe.” to express his belief that homosexuality is not wrong. His princepal tells him he must change his shirt or be suspended from school. John refuses, and is suspended for a week.. What do you think? Should the student be allowed to wear the T-shirt to school? Which freedom/amendments relates to this situation? Go to the article, which side won the case?

Student Sues To Wear 'Jesus Is Not A Homophobe' Shirt (Embed)
