Resource summary
1998 Human Rights Act
Until the year 2000, using the European Convention of Human Rights meant taking cases to Strasbourg as it was not part of UK law.
However, from 2000, the Human Rights Act made the rights from the ECHR enforcable in Uk courts, making it quicker to use.
Senior judges have to consider making a 'declaration of incompatibility' if an existing UK law conflicts with the European Convention of Human Rights
Some people have criticised the Human Rights Act as it allows everyone to have rights (even criminals, in certain circumstances).
The reason that they allow everyone to have rights is because of the danger they would face if they didn't.
Many rights can easily be claimed and the best way to get information is through your Citizens Advise Bureau.
