Software is licensed for use but there is no charge for the licence. Anyone can use it.
Open Source software must be distributed with the source code so anyone can modify it.
Developers can sell the software they have created.
Any new software created from Open Source software must also be ‘open’. This means that it must be distributed or sold in a form that other people can read and also edit.
Proprietary software is sold in the form of a licence to use it
There will be restrictions on how the software can be used, for example the license may specify only one concurrent user, or it may permit up to say, 50 users on one site (site licence)
The company or person who wrote the software will hold the copyright
The users will not have access to the source code and will not be allowed to modify the package and sell it to other people. - 6The Data Protection Act 1998This Act specifies the rules about collecting and holding data. Such as : the data must be accurate and up to date; you have a right to see what data is held about you; the data must be protected from unauthorised access.

Because personal data is held on hundreds of computers and we would like to be confident that this data is accurate and held for a specific purpose. A lot of this data is private and confidential and should not be available for anyone to look at and especially from people who may want to use it for wrongful or criminal purposes.
The Full Principles:
data must be processed fairly and lawfully; data must be adequate, relevant and not excessive; data must be accurate and up to date; data must not be retained for longer than necessary; data can only be used for the purpose for which it was collected; data must be kept secure; not transferred outside the European Economic Area (EEC) without adequate protection - 7Computer Misuse Act 1990asd
