Recognition

  1. Theories

    • Constitutive
      • A state doesn't exist until is recognized by other states Is not much in accordance with reality.
    • Declarative
      • Recognition is merely an acceptance of the existence. Which antecedes  the act of recognition.
  2. Of states

    • Recognition of the statehood of certain international entity
  3. Of Governments

    • Recognition of governments as distincts from states is now abolished. Recognition of a state implies recognition of its government
  4. De Facto

    • Implies cognition of the new state of affairs but is pendant of a definitive recognition. It might be a "sub judice" recognition until a definitive decision is made
  5. De Iure

    • Implies full recognition of capacities and personality of the state. Legal consequences.
    • Legal Effects
      • Internationally
        • Recognition of a state has effects in the International level. However it cannot be argued that non recognition of a states deemes it free from following norms of non agression
      • Internally
        • It can be said that to the domestic level recognition is constitutive because once the superior entity of the state recognizes other states, the autorithies at a lesser level are obliged to accept this recognition.
