Police Interviews

  1. Interviews should be taken place in a well heated, lit and ventilated room

  2. If the suspect is under the age of 17, or is mentally disordered or mentally vulnerable then there must be an 'appropriate adult' there in the room

  3. Right to silence

    • When they used to be questioned (before the Criminal Justice and Public Order Act 1994) they did not have to say anything however the Government felt as if guilty people were set free because of it. Therefore they changed their right to silence.
    • Because of this the wording was changed it now states:
      • "You do not have to say anything. But it may harm your defence when you do not mention when questioned something which you later rely on in court. Anything you do say will be given into evidence.
    • This means that the defendant does not have to speak however it may go against them later on
