About Commercial Contracts
GoConqr OriginalWhat this unit covers
The page sits in the Foundations of Commercial Law strand of Commercial and company law. Most of it is mind maps, and a large share of those look at technology contracts. Others deal with the basics of contract law, such as formation, validity, capacity and interpretation.
Start with the basics
Begin with the flashcard deck Intro MCC. It asks what a contract is, what an agreement is, which three types of law govern us, and which three errors are common in commercial contracts, including error in haste and error of misreading. Then open the mind maps A Valid Contract, Interpretation of contracts and LEGAL CAPACITY TO CONTRACT. The last one quotes sections 10 and 11 of the Contract Act on free consent and competence to contract.
Move to specialist contracts
Once the basics feel familiar, try the mind maps on the Mexican trust. Trustesheep and The Mexican Trustee set out the three parties, trustor, trustee and beneficiary, and the rules in Mexico's General law of credit instruments and operations. Next come the many maps called Technologic Contracts. They split software contracts from hardware contracts and separate commercial software, sold on fixed terms, from customised and specialist software. Because many people made them, you can compare how different authors organise the same ideas.
For negotiation, see the mind map on best practices in patent licence negotiation, and the one called NEGOTIATIONS AND LICENSING. The note Contract formation and closing the deal was created from a mind map.
Using maps, flashcards and the quiz together
- Read a mind map to see how a topic fits together.
- Run through a flashcard deck, such as International Business Law, to check the terms.
- Take the quiz CONTRACTS - THEORY 02 to see what you still need to revisit.
Teachers can use any map as a ready-made starting point for a seminar or a handout.
Where to go next
Pick one map that matches your current reading and work through it. Then make a few flashcards of your own for the terms that did not stick.
Frequently asked questions
Where should I start on this page?
Start with the Intro MCC flashcard deck, which covers what a contract is, what an agreement is and common errors in commercial contracts. Then read the mind maps A Valid Contract and Interpretation of contracts before moving on to the more specialised topics.
What do the Technologic Contracts mind maps cover?
They look at contracts for trading technological objects. Many split software contracts from hardware contracts, and describe commercial software sold on fixed terms alongside customised and specialist software. Several authors made their own versions, so you can compare how each one lays out the same ideas.
Is there a quiz?
Yes. The page lists one quiz, CONTRACTS - THEORY 02. It is a good way to check your understanding after reading the mind maps. There are also a few flashcard decks, including Intro MCC and International Business Law, for practising key terms.
Are these resources free, and who made them?
Every resource listed here is free to open and study, with no account needed. They were made by GoConqr users, not by GoConqr itself. A free account saves your quiz scores and lets you make your own quizzes, mind maps, flashcards and notes.
Is there anything on the Mexican trust?
Yes. The mind maps Trustesheep and The Mexican Trustee explain the trust, known as fideicomiso, as a commercial contract. They cover the three parties, trustor, trustee and beneficiary, the role of a financial entity such as a bank, and Mexico's General law of credit instruments and operations.
Who are these resources for?
They are aimed at university students studying commercial contracts and at teachers looking for ready-made material. Almost all of the resources are at university level, with a small share aimed at professionals, such as the patent licence negotiation maps.
